Child visitation basics

Divorces are very common in the United States, and they result in further litigation because of further differences between those involved. Divorces are particularly difficult for children because they are stuck between both parents and will have to live with one. Almost every divorce in which children are involved means a child custody negotiation is next. Parents do not want to be away from their child and do not want to give up their right to have custodial rights of their child. The parent that does not get custody has every right to have visitation rights, and the court makes these decisions after considering what is best for the child.

There are cases in which the court believes a certain parent is unfit and might have a negative impact on the child. But those cases are rare, and courts tend to make sure a parent is not separated from their child permanently.

A child visitation order is the first step towards attaining visitation rights. When you receive the order, it is important to make sure both parties are happy with the settlement. If both parents agree with the clauses, it is likely that the process will be smooth and simple. But complications arise if one parent wants more rights than stated in the agreement clause. If the visitation case has not already started, the parent who has issues with the agreement must file a complaint in court.

Child visitation cases are complicated, which is why it is important to have an experienced family attorney by your side. The attorney will oversee your case and try to get a decision in your favor.
