Divorce case finalized after custody battle

Divorce cases are often contentious. Couples who part ways often do so acrimoniously. Battles are typically waged over financial assets, future income, the family home and much more. Of course, the most tumultuous cases often center on child custody, and how much parenting time the father and mother respectively will get after the divorce. Issues affected include everything from who will wind up paying the majority of the bills to who will get to have the children living with them the majority of time. Specifics about upbringing and education often come into play as well.

In a recent case, the fight over the couple’s 5-year-old daughter has been a central issue to recent court battles. The daughter has lived with her father since June of 2010, more than half her life. He is her primary caregiver, and his home is her primary residence. However, the mother is still seeking temporary custody of the daughter, with her attorneys claiming that she did the majority of childcare prior to June of 2010.

The father says that even visitation for the mother would be unacceptably traumatic for the daughter. He was awarded a restraining order against the mother in 2010, after their 7-year-old son disappeared. In statements, he has made clear that, in his view, the mother was involved in the disappearance.

The couple’s divorce, just finalized, does not include a final resolution of child custody issues. The case underlines how complex those issues can be. It is critical for anyone who is involved in a child custody case to understand his or her rights and responsibilities. An experienced Louisiana family law attorney can help you navigate the legal system in such a case.
