Custody, parental rights at forefront of family law case

Louisiana residents may be interested in a situation taking place in another state involving the custody of a 3-year-old girl. The family law case is underway due to the girl’s biological father seeking custody after his recent release from jail. Apparently, the girl’s mother had lost custody of the child due to drug issues, and a family began fostering her when she was 3 weeks old. 

In 2015, the foster family adopted the girl. However, it was recently ruled that the adoption was invalid because statutory grounds for terminating the father’s parental rights were not met. Despite the fact he was in jail at the time of the adoption, the man had made efforts to write to his daughter and to the Department of Social Services in regard to her wellbeing. 

This effort indicated that the man did in fact wish to be a part of his daughter’s life, which led to the overturning of the adoption. The adoptive family believes that this ruling will break up their family and force the girl to live with a man she’s never met. As a result, the family is working to have a re-hearing on the topic of the girl’s custody. 

Because family law issues can easily become complicated, especially in cases with extenuating circumstances, individuals may quickly feel overwhelmed.
