Making The Complex Understandable

Is it worth it to talk about a prenuptial agreement?

Prenuptial agreements are not a popular topic. Sitting down to discuss one takes a lot of courage; more even than most couples can muster. It's understandable. At face value, a prenuptial seems to make preparations for a divorce, at exactly the time you're making preparations for marriage. The two seem to be diametrically opposed, but there's actually a lot of good a prenup can do, even if you never get divorced.

Yes, the primary purpose of a prenuptial agreement is to put down in writing who will get what if you do end up splitting. However, a prenuptial agreement can also deal with things like who will handle the monthly bills, solidify estate plans and separate debts; essentially, how you want to run your lives.

Just sitting down together to discuss the financial matters that a prenup covers can be an incredible boon for a relationship. Couples can discover each other's financial goals, discuss how each one likes to handle savings and talk about priorities with money.

Studies have shown that arguments over financial issues are the biggest cause of divorce, so getting on the same page in this area can make a huge difference. Plus, you'll be discussing these matters in a calm setting (perhaps with a glass of wine and a nice dinner) rather than negotiating in a hostile environment.

If you have questions about what you can include or you need help drafting a prenuptial agreement, a family law attorney may be able to sit down with you and your significant other to lend a hand.
